ExamAI is operated by Nathan Mercieca ("we", "us", "ExamAI"). By creating an account or continuing to use ExamAI you agree to these terms. If you do not agree, please stop using the service.
1. Who can use ExamAI
You must be old enough to enter a contract in your country, or have permission from a parent, guardian or school. If you accept these terms for a school or organisation, you confirm you have authority to bind it.
2. The service
ExamAI lets students upload study material and past papers and uses artificial intelligence to generate practice questions, mark answers, analyse past papers and build revision plans. AI output can be inaccurate or incomplete. It is study support only and is not an official examiner decision, an exam prediction, or professional advice. Always check important answers against your own notes, textbooks and teachers.
3. Your account
- Give accurate information and keep it up to date.
- Keep your password confidential; you are responsible for activity on your account.
- Tell us promptly if you believe your account has been accessed by someone else.
4. Acceptable use
You must not:
- use ExamAI for anything unlawful, fraudulent or abusive, including spam;
- upload content you do not have the rights to use, or that infringes copyright;
- upload or generate illegal content, hate speech, harassment, malware, or material that impersonates a real person;
- attempt to jailbreak, probe, scrape, reverse engineer, overload or interfere with the service or its security;
- resell, redistribute or share paid access outside the seats you have purchased;
- use ExamAI to cheat in a live examination or to breach your exam board's rules.
You are responsible for the prompts you enter, the material you upload and how you use the output, including verifying its accuracy.
5. Your content and intellectual property
You keep ownership of the notes, papers and answers you upload. You grant us a limited licence to store and process that content solely to provide the service to you. We keep ownership of ExamAI itself, including its software, design and branding, and grant you a limited, non-exclusive, non-transferable right to use it within your plan.
If you believe content on ExamAI infringes your rights, email support@examhelpai.lovable.app with the details and we will review and remove infringing material. Accounts that repeatedly infringe will be terminated.
6. Content moderation
We may remove or restrict content, filter or refuse AI output, and suspend accounts where we reasonably believe these terms have been broken.
7. Payment, subscriptions and tax
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, currency, tax, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Paid plans renew monthly until cancelled. Prices are shown in pounds sterling and may change with notice for future billing periods.
8. Availability
We work to keep ExamAI available, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may interrupt the service.
9. Suspension and termination
We may suspend or end access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. You can stop using ExamAI at any time. When your account ends you can ask us to export your data within 30 days, after which it may be deleted.
10. Warranties and liability
To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including lost profits, data or exam results. Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
11. Indemnity
You agree to cover claims arising from content you upload, your unlawful use of the service, or your breach of these terms.
12. General
You may not transfer your rights under these terms without our consent; we may transfer ours in a merger or sale. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of Malta and disputes are subject to the courts of Malta, unless local consumer law gives you the right to bring a claim elsewhere.
